Article 1 - General Conditions

  • You accept these terms and conditions from the moment you contact me to order, even if the request is not fulfilled or the contract is not yet signed.
  • I may decline any order for any reason, without having to justify myself.
  • The formats and dimensions of the drawing are at the client's request, taking into account the limits of the artist's production capacities.
  • A pre-contractual discussion should be held to define the drawing to be made: style of drawing, options chosen, subject and its description, etc.
  • The following are not accepted:
    • pornographic subjects;
    • subjects that do not respect the limits of French law: hateful or racist content, fanart, use of images or representations of copyrighted content, etc;
    If you hesitate or are unsure of the limitations involved, come and discuss it: this does not engage you to place an order.
  • Ordering steps:
    • Contact me and establish together whether the order is feasible, define the price and payment terms and preparation of the contract;
    • Signature of the contract;
    • PFirst or single payment according to the chosen formula (see Article 2 below);
    • Upon receipt of payment, a sketch of the design is made and submitted to the client for validation;
    • If payment in two times is chosen: second payment;
    • Upon receipt of the second payment, if any, the rest of the design is produced.
      Various validation stages will be set up to ensure the correct execution of the work;
    • Validation of the final rendering, delivery of the work in the requested format and end of the contract.

Article 2 - Payment

  • The prices indicated on the site are indicative and relate to an estimate of hourly work. They include all taxes or VAT. Depending on your request, these may change at my own discretion.
  • Payments are to be made by bank transfer. No checks or cash. Please ask me for any other payment method.
  • Work will only be started or continued on receipt of payment. As a reminder, for bank transfers, the transit time between banks can be up to two days.
  • I offer two payment options to be chosen before signing the contract:
    • pay 100% of the price before the start of the work;
    • pay 50% before the start of the work and 50% after validation of the sketch.

Article 3 - Deadline of completion

  • The basic contracts provide for a period of 6 to 75 working days, i.e. a maximum of three months. This period does not include waiting time (waiting for a response from the client, validation, receipt of payment, etc.). Working days are all days excluding French public holidays and Sundays. This period may be extended under one of the following conditions:
    • Before signing the contract, depending on my work, orders already in progress or the complexity of the order;
    • Because of too many or too heavy requests for changes during the execution;
    • If a date has been set for a customer requirement. Please inform me before signing the contract if the work is limited in time (for example, if it is a gift or a drawing for an event).

Article 4 - Modifications and compliance with expectations

  • As the project progresses, several validation stages will be necessary to ensure that the project meets expectations.
    Once the elements have been validated, a request for modification concerning them may lead to the invoicing of a supplement or may be refused.
  • A request for modification outside the terms of the signed contract may also lead to the invoicing of a supplement or to a decline of the execution of the modification.
  • You undertake to provide a sufficiently detailed description, references and any other element necessary to understand your expectations.

Article 5 - Termination and refund

  • The contract can only be cancelled by mutual agreement, including if the reason is non-compliance with the contract.
    If the contract is cancelled, regardless of which party is at fault, the Client has no right to the previews, examples, sketches or the beginnings of the work presented during the discussions for validation of the various stages, including the right of personal use or distribution on social networks.
    If the parties are unable to reach an agreement on the termination of the contract, the resolution of the dispute shall be left to the competent court (see Article 7).
  • In case of impossibility to carry out the order despite the signature of the contract, and whatever the reason, the artist can break the contract in agreement with the Client.
    The Client has no right to the previews, examples, sketches or beginnings of the work presented during the discussions and to validate the various stages already completed, not even the right of personal use or distribution on social networks.
    In case of such a termination, the Provider guarantees to refund all sums paid by the Client under the contract in question.
  • The refund is only possible in one of the following cases:
    • In case of a violation of one of the terms of the contract by the artist;
    • In case of termination of the contract for impossibility of realization as specified above;
    • If the work has not been started at the moment of a termination of the contract in any other case.
    Regardless of the purpose of the refund, the client retains no rights to any drawings, examples, sketches made under the contract.
    Otherwise, no refund of payments made can be claimed by the Client.

    The conditions of refund and transfer of rights may be adapted by mutual agreement in the event of a particular situation of termination of the contract.

Article 6 - Copyright and right of use

  • The artist:
    • Retains the moral rights to the work produced. As a reminder, these rights are perpetual, inalienable and imprescriptible. These rights include :
      • The right of divulgation;
      • The right of authorship;
      • The right to respect for the integrity of the work;
      • The right of withdrawal and repentance.
    • Undertakes not to resell or make any additional profit on the graphic work produced or on any drafts, sketches or other drawings made under the contract in question, except in the cases of his right of representation specified in the same article;
    • Shall not be able to transfer again the right of representation of the work, not even free of charge, as this right is transferred exclusively to the Client.
    • After the end of the contract, with or without termination of it, retains the right of representation and therefore to use and publish the work or any draft, sketch and other drawings made within the context of this contract on their website as well as in publications on social networks or for any communication aimed at advertising their work.
  • The Client, from the end of the contract :
    • Has a right of representation within the limits detailed below:
      • The Client may use the work in a personal context without limit of frequency;
      • The Client may publish the work on any website or social network other than royalty-free image websites as long as it is for personal use and may also print it or use it on a product that is strictly for the Client's personal use;
      • The Client agrees not to benefit financially from the work, not to use it for advertising or for any commercial product, not to resell it and not to use it for commercial purposes;
      • This transfer of rights is granted for the entire legal duration of copyright protection;
      • This transfer of rights does not imply any geographical limitation of representation.
    • According to the moral rights of the artist on the work:
      • The Client may not claim to be the author of the work;
      • The Client may not modify the work without the consent of the artist;
  • The subject of the work is at the request of the client, and the intellectual property of that subject therefore remains with the creator of that subject, whether it be the client, another person or entity who has given the client explicit permission to represent the subject, or the artist. Unless the artist is the creator or is authorised to do so by the person owning the intellectual property of the subject, they shall not be able to benefit again from the subject of the work.

Article 7 - Methods of recourse available to the consumer in the event of a disagreement

  • Any dispute will be dealt with according to French law with the judicial court of Rodez (FRANCE):
